Local Government Amendment Regulations 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Local Government Act 1993 .

1.   Short title

These regulations may be cited as the Local Government Amendment Regulations 2000 .

2.   Commencement

These regulations take effect on 8 November 2000.

3.   Principal Regulations

In these regulations, the Local Government Regulations 1994 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by omitting the definition of first meeting and substituting the following definition:
first meeting means a council meeting at which an election is to be held under section 43A or section 44 of the Act;
(b) by omitting "elections of the mayor and deputy mayor" from the definition of nominating period and substituting "elections of a mayor or deputy mayor".

5.    Regulation 4 amended (Nominations for mayor and deputy mayor)

Regulation 4 of the Principal Regulations is amended as follows:
(a) by omitting paragraphs (a) and (b) from subregulation (1) and substituting the following paragraphs:
(a) a notice of an election for mayor or deputy mayor; and
(b) nomination forms for the election.
(b) by omitting from subregulation (4) "position" and substituting "office of mayor or deputy mayor";
(c) by omitting from subregulation (5) "any position" and substituting "the office of mayor or deputy mayor";
(d) by omitting from subregulation (6) "position" and substituting "office".

6.    Regulation 22 rescinded

Regulation 22 of the Principal Regulations is rescinded.

7.    Regulation 26 amended (Petitions)

Regulation 26 of the Principal Regulations is amended by omitting " 30(1) ,".

8.    Regulation 27 rescinded

Regulation 27 of the Principal Regulations is rescinded.

9.    Regulation 29 amended (Allowances for elected members)

Regulation 29 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulation:
(1)  The annual allowances payable to a mayor, deputy mayor or councillor are as follows:

10.    Regulation 32 substituted

Regulation 32 of the Principal Regulations is rescinded and the following regulation is substituted:

32.   Annual report

(1)  The council is to prepare an annual report.
(2)  An annual report is to include –
(a) a statement reporting on the council's plans in relation to water supplied by it for domestic consumption; and
(b) sufficient financial information to demonstrate that it is applying the pricing guidelines in relation to water supplied by it for domestic consumption as specified in the Urban Water Pricing Guidelines (October 1999) issued by the Government Prices Oversight Commission.

11.    Regulation 35 amended (Tenders)

Regulation 35 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1)(b) "matter" and substituting "details";
(b) by omitting from subregulation (3)(c) "matter" and substituting "details";
(c) by inserting the following subregulation after subregulation (3) :
(4)  For the purpose of section 346(1) of the Act, the prescribed amount is $55 000.

12.    Schedule 1 amended (Forms)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting Form 1 and substituting the following form:

(b) by omitting Forms 2 and 3 .

13.    Schedule 2 amended (Fees)

Schedule 2 to the Principal Regulations is amended by omitting "certificate of council's rights in and powers over land" from item 1 and substituting "council certificate".

(This note is not part of the regulation)

These regulations amend the Local Government Regulations 1994 by –
(a) amending certain provisions relating to the election by councillors of mayors or deputy mayors; and
(b) rescinding certain provisions.
