Poisons Amendment Regulations (No. 2) 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations (No. 2) 2000 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 1975 are referred to as the Principal Regulations.

4.   Regulation 16C inserted

After regulation 16B of the Principal Regulations, the following regulation is inserted:

16C.   Minister's authorisation for possession and supply of narcotic substance

For the purposes of section 25A of the Act, the Minister may authorise a registered nurse employed in the Statewide Palliative Care Service of the Department, in the circumstances and subject to the conditions specified in the authorisation, to be in possession of and to supply such narcotic substances or classes of narcotic substances as may be specified in that authorisation.

5.   Regulation 32AA amended (Emergency prescribing and dispensing of restricted substances)

Regulation 32AA(2)(b) of the Principal Regulations is amended by omitting "narcotic" and substituting "restricted".

6.   Regulation 37E inserted

After regulation 37D of the Principal Regulations, the following regulation is inserted:

37E.   Minister's authorisation for possession and supply of restricted substance

For the purposes of section 25A of the Act, the Minister may authorise a registered nurse employed in the Statewide Palliative Care Service of the Department, in the circumstances and subject to the conditions specified in the authorisation, to be in possession of and to supply such restricted substances or classes of restricted substances as may be specified in that authorisation.

7.   Regulation 56 amended (Labelling of dispensed medicines)

Regulation 56(3) of the Principal Regulations is amended by omitting paragraph (bb) and substituting the following paragraphs:
(bb) where the medicine is levocabastine, a warning statement in the form, or to the effect, of warning statement 62 in Part 1 of Appendix F to the Uniform Standard;
(bc) where the medicine is acitretin, adapalene, etretinate, isotretinoin, thalidomide or tretinoin –
(i) for oral use, warning statements in the form, or to the effect, of warning statements 7, 62 and 76 in Part 1 of Appendix F to the Uniform Standard; or
(ii) for topical, warning statements in the form, or to the effect, of warning statements 62 and 77 in Part 1 of Appendix F to the Uniform Standard;
(bd) where the medicine is leflunomide, warning statements in the form, or to the effect, of warning statements 7, 62 and 87 in Part 1 of Appendix F to the Uniform Standard;
(be) where the medicine is misoprostol, a warning statement in the form, or to the effect, of warning statement 53 in Part 1 of Appendix F to the Uniform Standard;
(bf) where the medicine is for animal treatment, the words "For animal treatment only".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 1975  –
(a) to allow the Minister to authorise registered nurses working in palliative care to obtain and administer certain narcotic substances and restricted substances; and
(a) in respect of the labelling of certain medicines in accordance with the requirements of the Standard for the Uniform Scheduling of Drugs and Poisons.
