Government Prices Oversight (Metro Bus Fares) Order 2000
I make the following order under section 36 of the Government Prices Oversight Act 1995 .

This order may be cited as the Government Prices Oversight (Metro Bus Fares) Order 2000 .
This order takes effect 61 days after the day on which its making is notified in the Gazette.
(1) In this order, unless the contrary intention appears Agreement means the agreement in respect of the provision of (a) scheduled route services and made on 21 August 2000 between The Crown (in Right of the State of Tasmania) and Metro Tasmania Pty. Ltd., signed on behalf of the Crown by The Honourable Paul Anthony Lennon MHA, and on behalf of Metro Tasmania Pty. Ltd. by the Chairperson of the Metro Board; and(b) any agreement in respect of scheduled route services between the Crown (in Right of the State of Tasmania) and Metro Tasmania Pty. Ltd., being an agreement that replaces or supersedes the agreement referred to in paragraph (a) ;Commission means the Government Prices Oversight Commission;GST has the same meaning as in the A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth;full adult fares means the fares to be charged to full fare-paying adult passengers for single-ride tickets and multi-ride tickets;initial ceiling fares means the maximum full adult fares specified in Schedule 2 , being the maximum full adult fares that Metro may charge on the day on which this order takes effect;initial fares means the full adult fares specified as initial fares in Schedule 1 ;Initial Metro Index is 100, being the value of the Metro Index calculated on 1 July 2000;initial weighted average fare is $5.35, being the weighted average fare calculated in accordance with Schedule 3 using the initial fares;maximum ceiling fare means the maximum full adult fare that Metro may charge as calculated in accordance with clause 7 ;maximum weighted average fare means the maximum weighted average fare (full adult fare) that Metro may charge, as calculated in accordance with clause 8 ;Metro means Metro Tasmania Pty. Ltd.;Metro Index is the value calculated in accordance with clause 6 ;scheduled route services means the regular passenger transport services specified in the Agreement as comprising the Community Service Activity that Metro is contracted to deliver;weighted average fare means the weighted average fare calculated in accordance with Schedule 3 using the full adult fares charged by Metro immediately before the calculation.(2) The Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were by-laws.(3) A reference in this order to a publication includes a reference to (a) that publication as amended from time to time; and(b) a publication published in substitution for that publication.
This order specifies the maximum full adult fares that Metro may charge for travel on scheduled route services.
The full adult fares charged by Metro must comply with the following requirements:(a) the full adult fares must not exceed the relevant maximum ceiling fares calculated in accordance with clause 7 ;(b) the weighted average fare must not exceed the maximum weighted average fare.
(1) The Metro Index is calculated in accordance with the following formula:(2) In this clause ANZSIC means the Australian and New Zealand Standard Industrial Classification;average fuel cost is the average of all prices (inclusive of GST) paid by Metro to fuel suppliers for diesel fuel delivered during the period of 3 months ending on the last day of the immediately preceding month under contracts between Metro and those suppliers;Current Fuel Index is the latest available index number obtained by dividing the average fuel cost by 1.1 (to make net of GST) and then subtracting 17.798 (to make net of Commonwealth fuel rebate);Current Labour Index is the latest available index number for the Wage Cost Index for the Transport and Storage Industry Sector, for private and public workers, Ordinary time hourly rates of pay excluding bonuses, as set out in Table 9B of Publication No. 6345.0 published by the Australian Bureau of Statistics;Current Other Factors Index is the latest available index number for the Consumer Price Index: All Groups Index Number for Hobart as set out in Table 1 of Publication No. 6401.0 published by the Australian Bureau of Statistics;Current Parts Index is the latest available index number set out in Subdivisions 281 and 282 (Transport equipment and parts) in Table 4: Manufacturing ANZSIC Subdivision and Group Indexes (a) in the Price Indexes of Materials Used in Manufacturing Industries published as Publication No. 6411.0 by the Australian Bureau of Statistics;Initial Fuel Index is 50.38;Initial Labour Index is 106.00;Initial Other Factors Index is 125.30;Initial Parts Index is 120.40.
7. Calculating maximum ceiling fare
The maximum ceiling fare for a type of ticket specified in the table set out in Schedule 2 is the amount calculated by multiplying the initial ceiling fare specified in that table adjacent to that type of ticket by the Metro Index and then dividing that product by the Initial Metro Index.
8. Calculating maximum weighted average fare
The maximum weighted average fare is the amount calculated by multiplying the initial weighted average fare by the Metro Index and then dividing that product by the Initial Metro Index.
This order ceases to have effect at the end of the period of 3 years commencing on the day on which this order takes effect.
