Ben Lomond Skifield Management Authority Regulations 2000

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Ben Lomond Skifield Management Authority Act 1995 .

1.   Short title

These regulations may be cited as the Ben Lomond Skifield Management Authority Regulations 2000 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

In these regulations,

Act means the Ben Lomond Skifield Management Authority Act 1995 .

4.   Collection of admission charges

(1)  The Authority may authorise a person to collect a charge for admission to the Skifield Development Area imposed under the Act.

(2)  A person authorised to collect an admission charge may require a person driving or in charge of a vehicle to stop the vehicle for the purpose of collecting the charge.

(3)  A person driving or in charge of a vehicle must comply with a requirement under subregulation (2) .

Penalty:   Fine not exceeding 5 penalty units.

(4)  A person driving or in charge of a vehicle in the Skifield Development Area must display a valid ticket, entry pass or other receipt issued in respect of an admission charge so that the ticket, entry pass or receipt is clearly visible through the windscreen of the vehicle.

Penalty:  Fine not exceeding 5 penalty units.

5.   Prescribed offences

For the purposes of Part 4A of the Act –

(a) an offence against section 22 of the Act or regulation 4(3) or (4) is a prescribed offence; and

(b) the specified penalty for such an offence is 0.25 penalty units.

EXPLANATORY NOTE

(This note is not part of the regulation)

(a) make provision for the collection of charges under the Ben Lomond Skifield Management Authority Act 1995 ; and

(b) prescribe offences for which an infringement notice may be issued under Part 4A of that Act and the specified penalty for those offences.
