Administrative Arrangements Amendment Order 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 4(1) of the Administrative Arrangements Act 1990 .

1.   Short title

This order may be cited as the Administrative Arrangements Amendment Order 2000 .

2.   Commencement

This order takes effect on 1 July 2000.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Principal Order

In this order, the Administrative Arrangements Order 2000 is referred to as the Principal Order.

5.    Schedule 1 amended (Administration of departments and enactments)

Schedule 1 to the Principal Order is amended as follows:
(a) by inserting "Mental Health Act 1996 in so far as it relates to the appointment, operation and the registrar and other officers of the Mental Health Tribunal" after "Married Women's Property Act 1935" in the list of Acts specified under the Department of Justice and Industrial Relations which appears under the heading "MINISTER FOR JUSTICE AND INDUSTRIAL RELATIONS";
(b) by inserting "and the appointment of the Registrar and deputy registrars of that Tribunal" after "Tribunal" at the end of the item relating to the Workers Rehabilitation and Compensation Act 1988 in the list of Acts specified under the Department of Justice and Industrial Relations which appears under the heading "MINISTER FOR JUSTICE AND INDUSTRIAL RELATIONS";
(c) by inserting "Child Care Act 1960" after "Building and Construction Industry Training Fund Act 1990" in the list of Acts specified under the Department of Education which appears under the heading "MINISTER FOR EDUCATION";
(d) by omitting "Child Welfare Act 1960" from the list of Acts specified under the Department of Health and Human Services which appears under the heading "MINISTER FOR HEALTH AND HUMAN SERVICES";
(e) by inserting "except in so far as it relates to the appointment, operation and the registrar and other officers of the Mental Health Tribunal" after "Mental Health Act 1996" in the list of Acts specified under the Department of Health and Human Services which appears under the heading "MINISTER FOR HEALTH AND HUMAN SERVICES";
(f) by inserting "and the appointment of the Registrar and deputy registrars of that Tribunal" after "Tribunal" at the end of the item relating to the Workers Rehabilitation and Compensation Act 1988 in the list of Acts specified under the Department of Infrastructure, Energy and Resources which appears under the heading "MINISTER FOR INFRASTRUCTURE, ENERGY AND RESOURCES".

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Administrative Arrangements Order 2000 by transferring responsibility for the Child Welfare Act 1960 , which from 1 July 2000 will be called the Child Care Act 1960 , from the Department of Health and Human Services to the Department of Education and assigns responsibility for the administration of parts of certain other Acts to certain departments.
