Poisons Amendment Regulations 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations 2000 .

2.   Commencement

(1)  These regulations, except regulations 4 and 6, take effect on the day on which their making is notified in the Gazette.
(2)  Regulations 4 and 6 take effect on 1 July 2000.

3.   Principal Regulations

In these regulations, the Poisons Regulations 1975 are referred to as the Principal Regulations.

4.   Regulation 2 amended (Interpretation)

Regulation 2(1) of the Principal Regulations is amended by omitting the definition of "Uniform Standard" and substituting the following definition:
Uniform Standard means the Standard for the Uniform Scheduling of Drugs and Poisons of the Commonwealth published by the Australian Government Publishing Service, as amended from time to time.

5.   Regulation 34AC amended (Supply of restricted substance in medical institution)

Regulation 34AC(1) of the Principal Regulations is amended by omitting "medical practitioner, dentist or veterinary surgeon" (twice occurring) and substituting "medical practitioner or dentist".

6.   Regulation 46 amended (Application of provisions of Uniform Standard)

Regulation 46(1) of the Principal Regulations is amended by omitting "paragraph 71" and substituting "paragraph 41".

7.   Regulation 62 amended (Administration of drugs by midwives under general orders)

Regulation 62 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (2) "either or both of the following in that hospital: –" and substituting "any one or more of the following things in that hospital in accordance with the order:";
(b) by omitting from subregulation (2)(a) ", in accordance with the order,";
(c) by omitting from subregulation (2)(b) ", in accordance with the order,";
(d) by omitting from subregulation (2)(b) "practitioner." and substituting "practitioner;";
(e) by inserting in subregulation (2) the following paragraph after paragraph (b):
(c) administer hepatitis B vaccine neonatally to a child born of a patient of that medical practitioner.
(f) by omitting from subregulation (3)(a) "drug or naloxone" and substituting "drug, naloxone or hepatitis B vaccine";
(g) by omitting from subregulation (4)(b) "drugs" and substituting "substances";
(h) by omitting paragraph (c) of subregulation (4);
(i) by omitting from subregulation (8) "either or both of the following in that hospital:–" and substituting "any one or more of the following things in that hospital in accordance with the order:";
(j) by omitting from subregulation (8)(a) ", in accordance with the order,";
(k) by omitting from subregulation (8)(b) ", in accordance with the order,";
(l) by omitting from subregulation (8)(b) "practitioner." and substituting "practitioner;";
(m) by inserting in subregulation (8) the following paragraph after paragraph (b):
(c) administer hepatitis B vaccine neonatally to a child born of a patient of that medical practitioner.
(n) by omitting from subregulation (11) "drug, or naloxone," and substituting "drug, naloxone or hepatitis B vaccine".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 1975 by –
(a) updating the definition of "Uniform Standard" and a reference to a provision of that standard; and
(b) providing, consistently with national immunisation policy, that hospital midwives may administer hepatitis B vaccine to newborn babies in accordance with general orders issued by medical practitioners; and
(c) omitting redundant references to veterinary surgeons.
