Traffic (Road Rules) Amendment Regulations 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Road Rules) Amendment Regulations 2000 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Rules

In these regulations, the Traffic (Road Rules) Regulations 1999 are referred to as the Principal Rules.

4.   Rule 217 amended (Using rear fog lights)

Rule 217(2) of the Principal Rules is amended by omitting "light" second occurring from the definition of "rear fog light".

5.   Rule 293 amended (Removing fallen, &c., things from the road)

Rule 293(1) of the Principal Rules is amended by omitting "Penalty: Fine not exceeding 5 penalty units.".

6.   Rule 383 amended (Exemption for transport inspector)

Rule 383 of the Principal Rules is amended as follows:
(a) by omitting from subrule (1)(c) "and" and substituting "or";
(b) by inserting in subrule (1)(c) ", or both" after "light";
(c) by inserting the following paragraph after paragraph (h) in subrule (2):
(ha) Subrule (3) of rule 268 (How persons must travel in or on a motor vehicle);

7.    Schedule 6 amended (Jurisdictional qualifications)

Part 1 of Schedule 6 to the Principal Rules is amended as follows:
(a) by omitting clause 8 and substituting the following clause:
8.   Rule 288: Driving on a path
For rule 288 , a driver is permitted to drive on a path if –
(a) the driver's vehicle is being used in connection with works being carried out by a Road Authority; and
(b) in the circumstances it is not practicable to comply with the rule; and
(c) the driver takes reasonable care and does not exceed 10 kilometres per hour.

Note: Road Authority is defined in the dictionary.

(b) by inserting the following clause after clause 9 :
10.   Rule 313: Exemption for postal vehicles
For rule 313 , none of the provisions mentioned in subrule (2) of the rule apply to the driver of a postal vehicle.

These regulations amend the Road Rules by –
(a) exempting postal vehicles and transport inspectors from certain rules; and
(b) effecting statute law revision.
