Building Amendment Regulations 1999

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Building and Plumbing Regulations Board, make the following regulations under section 15 of the Local Government (Building and Miscellaneous Provisions) Act 1993 .

1.   Short title

These regulations may be cited as the Building Amendment Regulations 1999 .

2.   Commencement

These regulations take effect on 1 February 2000.

3.   Principal Regulations

In these regulations, the Building Regulations 1994 are referred to as the Principal Regulations.

4.   Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended as follows:
(a) by inserting after the definition of "building certificate" the following definition:
building surveying certificate means a building surveying certificate referred to in regulation 8A;
(b) by inserting after the definition of "practising" the following definition:
private building surveyor means a person who –
(a) is qualified and competent to be appointed as a building surveyor under section 24 of the Act and has not been so appointed by the relevant council; and
(b) does not have any interest in any proposed building work in respect of which he or she proposes to give a building surveying certificate.

5.   Regulation 8A inserted

After regulation 8 of the Principal Regulations, the following regulation is inserted:

8A.   Building surveying certificate

(1)  An applicant may submit with an application, a building surveying certificate given by a practising private building surveyor certifying that the proposed building work, if it is carried out in accordance with the certified drawings and specifications, is likely to comply with all or part of the requirements of the Building Code of Australia.
(2)  A building surveying certificate is to be in an approved form.

6.   Regulation 9 amended (Acceptance of certificates)

Regulation 9 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "or a building surveying certificate" after "certificate", first occurring;
(b) by inserting in subregulation (2) "or a building surveying certificate" after "certificate", first occurring;
(c) by inserting in subregulation 2(a) "sufficient" before "evidence".

7.   Regulation 20 amended (Consent to applications)

Regulation 20 of the Principal Regulations is amended by inserting "on reasonable grounds" after "satisfied".

8.   Regulation 66 amended (Review of documents)

Regulation 66 of the Principal Regulations is amended as follows:
(a) by omitting subregulation (3);
(b) by omitting from subregulation (4) "The fee" and substituting "A fee".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Building Regulations 1994 in respect of –
(a) the submission to a council of a building surveying certificate in relation to proposed building work; and
(b) fees for the review of documents.
