Fluoridation Amendment Regulations 1999

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Fluoridation Committee, make the following regulations under the Fluoridation Act 1968 .

1.   Short title

These regulations may be cited as the Fluoridation Amendment Regulations 1999 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Fluoridation Regulations 1999 are referred to as the Principal Regulations.

4.    Regulation 3 substituted

Regulation 3 of the Principal Regulations is rescinded and the following regulation is substituted:

3.   Interpretation

In these regulations –
Act means the Fluoridation Act 1968 ;
recognised laboratory means a laboratory that is accredited by the National Association of Testing Authorities, Australia.

5.    Regulation 5 amended (Analyses and tests)

Regulation 5 of the Principal Regulations is amended as follows:
(a) by omitting subregulations (1) and (2) and substituting the following subregulations:
(1)  A water supply authority having the control of a fluoridated water supply is to take samples from that water supply, for the purpose of making analyses and tests of those samples, from such points on the reticulation system of that water supply as the Committee determines.
(2)  The analyses and tests of the samples are to be of such nature and made at such frequency as the Committee determines.
(b) by omitting from subregulation (3) "3 months" and substituting "6 months";
(c) by inserting in subregulation (5) "or an analyst from a recognised laboratory" after "Analyst".

These regulations amend the Fluoridation Regulations 1999 in respect of the following:
(a) the taking of samples from a fluoridated water supply;
(b) the analysis and testing of those samples.
