Fisheries (General and Fees) Amendment Regulations (No. 2) 1999

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Living Marine Resources Management Act 1995 .

1.   Short title

These regulations may be cited as the Fisheries (General and Fees) Amendment Regulations (No. 2) 1999 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Fisheries (General and Fees) Regulations 1996 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by omitting the definition of carapace ;
(b) by omitting the definition of export .

5.    Regulation 4 amended (Minimum sizes of certain fish)

Regulation 4(1) of the Principal Regulations is amended by omitting paragraph (c) .

6.    Regulation 5 rescinded

Regulation 5 of the Principal Regulations is rescinded.

7.    Regulation 19 amended (Storing fish)

Regulation 19 of the Principal Regulations is amended by inserting ", giant crab" after "Abalone".

8.    Regulation 19B amended (Processing of fish of prescribed amounts and species)

Regulation 19B(a) of the Principal Regulations is amended by omitting subparagraph (iii) and substituting the following subparagraphs:
(iii) any amount in respect of giant crab; and
(iv) any amount in respect of scallops; and
(v) 10 tonnes or more in respect of any other species or a combination of other species; and

9.    Regulation 20 amended (Noxious fish)

Regulation 20 of the Principal Regulations is amended by inserting after paragraph (b) the following paragraph:
(ba) black striped mussel (Mytilopsis sallei);

10.   Schedule 1 amended (Licence fees)

Part 1 of Schedule 1 to the Principal Regulations is amended by omitting items 11 and 13 and substituting the following:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations make further provision relating to –
(a) sizes and measurements of certain fish;
(b) storing fish; and
(c) noxious fish; and
(d) fees for various licences.
