Registration of Deeds Amendment (Fees) Regulations 1999

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Registration of Deeds Act 1935 .

1.   Short title

These regulations may be cited as the Registration of Deeds Amendment (Fees) Regulations 1999 .

2.   Commencement

These regulations take effect on the thirtieth day after the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Registration of Deeds Regulations 1976 are referred to as the Principal Regulations.

4.   Regulation 14 substituted (Fees)

Regulation 14 of the Principal Regulations is rescinded and the following regulation is substituted:

14.   Fees

(1)  The fees set out in Schedule III are prescribed as the fees that are payable to the Registrar for the purposes of the Act.
(2)  In the Schedule,
Fee units means fee units within the meaning of the Fee Units Act 1997 .
(3)  This regulation expires on 30 June 2000.

5.   Schedule III substituted (Fees)

Schedule III to the Principal Regulations is rescinded and the following Schedule is substituted:

On application to inspect deposited deeds or documents

On application to search indexes, memorials, plans, field notes and other records in the Register (for each chain of title)

On application or request for photographic copy of single memorial, record or other document or survey plan kept in Registry (if fee has not been paid under item 4)

On application under item 5 if Registrar is requested to certify copy (whether or not fee has been paid under item 4)

On application for registration of a power of attorney, reconveyance or release or discharge of a charge, registered lien or judgment

These regulations revise, and in some cases increase, the fees that are payable under the Registration of Deeds Act 1935 .
