Fair Trading (Code of Practice for Motor Vehicle Traders) Amendment Regulations 1999

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Fair Trading Act 1990 .

1.   Short title

These regulations may be cited as the Fair Trading (Code of Practice for Motor Vehicle Traders) Amendment Regulations 1999 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Fair Trading (Code of Practice for Motor Vehicle Traders) Regulations 1996 are referred to as the Principal Regulations.

4.    Regulation 4 inserted

After regulation 3 of the Principal Regulations , the following regulation is inserted:

4.   Penalty provision

A person must not contravene or fail to comply with a provision of the code of practice for motor vehicle traders.
Penalty:  Fine not exceeding 10 penalty units and a daily fine not exceeding 5 penalty units.

5.   Schedule 1 amended (Code of Practice for Motor Vehicle Traders)

Schedule 1 to the Principal Regulations is amended by omitting "subclause (1)" from clause 17(5) of the Code of Practice for Motor Vehicle Traders set out in that Schedule and substituting "subclause (2)".

These regulations amend the Fair Trading (Code of Practice for Motor Vehicle Traders) Regulations 1996 by –
(a) prescribing a penalty for a breach of the Code of Practice for Motor Vehicle Traders; and
(b) correcting a reference.
