Inland Fisheries (Seasons and Waters) Amendment Order 1999

I make the following order under section 197 of the Inland Fisheries Act 1995 .

1.   Short title

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 1999 .

2.   Commencement

This order takes effect on 31 July 1999.

3.   Principal Order

In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.

4.    Clause 4 substituted

Clause 4 of the Principal Order is revoked and the following clause is substituted:

4.   Taking of acclimatised fish

(1)  Acclimatised fish may only be taken during the following periods at the following places:
(a) between the Saturday nearest 1 August in any year and the Sunday nearest 31 May in the next year –
(i) Great Lake, other than Canal Bay; and
(ii) Lake Mackintosh; and
(iii) Lake Rosebery; and
(iv) Lake Burbury;
(b) between the Saturday nearest 1 October in any year and the Sunday nearest 31 May in the next year –
(i) Dee Lagoon; and
(ii) Lake Rowallan; and
(iii) Lagoon of Islands; and
(iv) Lake Skinner;
(c) between the Saturday nearest 1 November in any year and the Sunday nearest 31 March in the next year –
(i) Canal Bay in Great Lake; and
(ii) that portion of the canal conveying water from Bronte Lagoon to Bradys lake, between the control gates in that canal on the Bronte-Tarraleah road and where the water enters Bradys Lake;
(iii) that portion of the canal conveying water from Pine Tier Dam to Bronte Lagoon, between the Marlborough Highway and for a distance of approximately 100 metres below the bridge on the Lyell Highway and marked by 2 white posts on opposite points of the canal; and
(iv) that portion of the canal conveying water from Dee Lagoon to Bradys Lake, between the mouth of the tunnel and Bradys Lake defined by 2 white posts on opposite points of the canal;
(d) between the Saturday nearest 1 November in any year and the Sunday nearest 30 April in the next year, in that portion of the Mersey River above Lake Rowallan, above 2 white posts on opposite shores of the river;
(e) between the Saturday nearest 1 November in any year and the Sunday nearest 31 March in the next year, in that portion of the Derwent River between the road bridge on the Lyell Highway at Derwent Bridge and the Hydro-Electric Corporation's radial gate at Lake St Clair.
(2)  Acclimatised fish may only be taken between the Saturday nearest 1 August in any year and the Sunday nearest 30 April in the next year, if no other period is specified –
(a) in excepted waters; and
(b) in any inland waters that are not specified in clause 8 ; and
(c) at Four Springs Lake from one hour before sunrise to one hour after sunset; and
(d) at Middle Myrtle Pond between 8.30 a.m. and 9 p.m..

5.    Clause 7 substituted

Clause 7 of the Principal Order is revoked and the following clause is substituted:

7.   Taking fish in certain waters

(1)  The taking of any fish in Risdon Brook Reservoir is permitted only by an eligible person.
(2)  The taking of any fish in Coffee Creek and Middle Myrtle Pond is permitted only by the following persons:
(a) an eligible person;
(b) a person who –
(i) is wholly or partially blind; or
(ii) has a permanent physical disability that causes the person to be physically reliant on a wheelchair or mobility aid; or
(iii) is unable to walk a distance of 50 metres without the assistance of any aid; or
(iv) has a physical or mental disability that would otherwise prevent the person from access to inland fishing; or
(v) has a mental disability or a behavioural disorder that requires the person to be supervised while fishing;
(c) a person who is –
(i) under the age of 16 years; and
(ii) accompanied by a person who is 18 years of age or more.

6.    Clause 8 amended (Prohibition on taking fish)

Clause 8 of the Principal Order is amended as follows:
(a) by omitting paragraph (ab) ;
(b) by omitting paragraph (da) ;
(c) by inserting in paragraph (pa) "and Middle Myrtle Pond" after "River".

7.    Clause 9 revoked

Clause 9 of the Principal Order is revoked.

This order amends the Inland Fisheries (Seasons and Waters) Order 1996 in respect of –
(a) the taking of fish in certain waters; and
(b) prohibitions on taking fish; and
(c) certain expired provisions.
