Mental Health (The Roy Fagan Centre) Order 1999

I make the following order under sections 6(1) and (2) of the Mental Health Act 1963 .

1.   Short title

This order may be cited as the Mental Health (The Roy Fagan Centre) Order 1999 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Declaration of The Roy Fagan Centre as hospital

The Roy Fagan Centre which –
(a) is situated at Lenah Valley in Tasmania; and
(b) is maintained by the State as a psychogeriatric institution –
is declared to be a hospital for the purposes of the Mental Health Act 1963 .

5.   Declaration of hospital authority

The person for the time being holding the office of Senior Psychiatrist at The Roy Fagan Centre is declared to be the hospital authority for that institution.

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Health and Human Services.

EXPLANATORY NOTE

(This note is not part of the order)

This order –
(a) declares The Roy Fagan Centre in Lenah Valley to be a hospital for the purposes of the Mental Health Act 1963 ; and
(b) declares the Senior Psychiatrist of The Roy Fagan Centre to be the hospital authority for that institution.
