Government Prices Oversight (Water Tariffs) Order 1999
I make the following order under the Government Prices Oversight Act 1995 .

This order may be cited as the Government Prices Oversight (Water Tariffs) Order 1999 .
This order takes effect on the 61st day after the day on which notification of its making is notified in the Gazette.
(1) In this order Authority means the North West Regional Water Authority;nodal tariff structure means a two-part tariff structure in which (a) the volumetric component is established on the basis of the long-run marginal costs of the supply of bulk water to the delivery node; and(b) the fixed component is established on the basis of the share of the bulk water supply network used by a customer obtaining bulk water from the Authority;two-part tariff structure means a tariff structure that is in 2 parts, with one part being the volumetric component reflecting the long-run marginal costs of the Authority and the other part being the fixed component reflecting any revenue shortfall of the Authority.(2) For the purposes of the definition of "nodal tariff structure", share of the bulk water supply network is to be determined by estimating the capacity of the bulk water system at each bulk water delivery point after making any adjustments the Authority considers appropriate in response to information obtained from a system flow analysis.(3) The Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were by-laws.
(1) The maximum price that the Authority may charge in respect of bulk water supply must be determined in accordance with the principle that the total revenue obtained from all bulk water supply in any financial year must not exceed $9 000 000.(2) As soon as practicable, the maximum price that the Authority may charge in respect of bulk water supply must be determined in accordance with the principle that the Authority must apply a two-part tariff structure.(3) As soon as practicable but not later than 1 July 2001, the maximum price that the Authority may charge in respect of bulk water supply must be determined in accordance with the principle that the Authority must apply a nodal tariff structure.(4) As soon as practicable, the maximum price that the Authority may charge in respect of bulk water supply must be determined in accordance with the principle that the tariff structure reflect any seasonal variation in the costs of supplying bulk water.
5. North West Regional Water Act 1987 amended
The North West Regional Water Act 1987 is amended as follows:(a) by omitting from section 45(1) "shall pay to the Authority an amount determined in accordance with the regulations" and substituting "must pay the Authority";(b) by omitting from section 50(2)(g) "and requiring payment for that basic allowance, whether the allowance is taken or not";(c) by omitting paragraphs (h) and (i) from section 50(2) ;(d) by omitting paragraph (j) from section 50(2) and substituting the following paragraph:(j) providing for penalties for late payment for water supplied; and(e) by omitting from section 50(3) " subsection (2) (g) , (h) , or (i) shall not" and substituting " subsection (2)(g) must not".
6. North West Regional Water (Charges) Regulations 1987 amended
The North West Regional Water (Charges) Regulations 1987 are amended as follows:(a) by omitting the definition of "unit rate" from regulation 3;(b) by omitting regulations 7, 8 and 9.

This order sets the maximum price chargeable by the North West Regional Water Authority for bulk water supply and makes consequential amendments to the North West Regional Water Act 1987 and the North West Regional Water (Charges) Regulations 1987 .
