Fisheries (General and Fees) Amendment Regulations (No. 2) 1998

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Living Marine Resources Management Act 1995 .

1.   Short title

These regulations may be cited as the Fisheries (General and Fees) Amendment Regulations (No. 2) 1998 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Fisheries (General and Fees) Regulations 1996 are referred to as the Principal Regulations.

4.    Regulation 6 amended (Minimum size of abalone)

Regulation 6 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (5) ", unless the person is operating under the authority of a fishing licence (abalone dive)" after "or not";
(b) by inserting the following subregulation after subregulation (7) :
(8)  A person operating under the authority of a fishing licence (abalone dive) must not take or have possession of greenlip abalone –
(a) the shell of which is 150 millimetres or less in its widest diameter whether the shell is broken or chipped in any way or not in waters or land other than those specified in paragraph (b); or
(b) the shell of which is 140 millimetres or less in its widest diameter, whether the shell is broken or chipped in any way or not –
(i) in State waters adjacent to the North West Coast of mainland Tasmania between the mouth of the Arthur River and Peggs Beach bounded by the line of latitude 41o3'34" South in the south, the line of longitude 144o20' East in the west, the line of latitude 40o20' South in the north and the line of longitude 145o20'35" East in the east; or
(ii) on any land adjacent to those waters.

These regulations prohibit the taking or possession of greenlip abalone of a certain size in certain waters.
