Traffic (General and Local) Amendment (Towing) Regulations 1998

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (General and Local) Amendment (Towing) Regulations 1998 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Traffic (General and Local) Regulations 1956 are referred to as the Principal Regulations.

4.   Regulation 17B amended (Motor vehicles not to draw other vehicles except in certain cases)

Subregulation 17B(3) of the Principal Regulations is omitted and the following subregulations are substituted:

(3)  A person, for the purpose of towing a trailer on a public street, must not drive or use, or cause or permit to be driven or used, a motor vehicle with a GVM not exceeding 4.5 tonnes if the trailer has a loaded mass exceeding whichever is the lesser of –

(a) the towing capacity of the motor vehicle; or

(b) the towing capacity of the towing apparatus fitted to the motor vehicle.

(3A)  For the purpose of subregulation (3)  –

towing capacity of the motor vehicle means –

(a) the towing capacity of the motor vehicle as specified by the manufacturer of the motor vehicle; or

(b) if a towing capacity is not specified or is not able to be identified –

(i) 1.5 times the unloaded mass of the motor vehicle, if the trailer is fitted with brakes; and

(ii) the unloaded mass of the motor vehicle, if the trailer is not fitted with brakes;

towing capacity of the towing apparatus means the towing capacity of the towing apparatus as specified by the manufacturer of the towing apparatus.

These regulations amend the Traffic (General and Local) Regulations 1956 for the purpose of adopting the national light vehicle towing policy.
