Racing and Gaming Amendment (Telephone Sports Betting) Regulations 1998

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Racing and Gaming Act 1952 .

1.   Short title

These regulations may be cited as the Racing and Gaming Amendment (Telephone Sports Betting) Regulations 1998 .

2.   Commencement

These regulations take effect on 1 September 1998.

3.   Principal Regulations

In these regulations, the Racing and Gaming Regulations 1976 are referred to as the Principal Regulations.

4.   Regulation 136A amended (Conditions of telephone sports betting licences)

Regulation 136A of the Principal Regulations is amended as follows:
(a) by omitting paragraph (a);
(b) by omitting "Authority" wherever occurring and substituting "Supervising Agency";
(c) by omitting "bookmaker's clerk, employed by the licensee and approved by the Authority," from paragraph (e) and substituting "registered bookmaker's clerk employed by the licensee";
(d) by omitting paragraphs (h) and (i) and substituting the following paragraphs:
(h) that the licensee must not make a bet other than in person unless the bet is electronically recorded under section 74F(d) of the Act;
(i) that the licensee must immediately notify the Supervising Agency of any failure of, or fault in, any device used to electronically record bets made other than in person under section 74F(d) of the Act;
(e) by inserting after paragraph (j) the following paragraph:
(ja) that the licensee must pay the costs incurred by the Supervising Agency in approving a device for the purpose of section 74F(d) of the Act;

5.   Regulation 138A amended (Advertising by holders of telephone sports betting licences)

Regulation 138A of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (2)(b) "Authority" and substituting "Supervising Agency";
(b) by omitting from subregulation (2)(c) "a newspaper notice" and inserting "notice in a newspaper or on a web site";
(c) by inserting "or web site address" in subregulation (2)(c)(iii) after "numbers";
(d) by omitting from subregulation (3)(b) "Authority" and substituting "Supervising Agency";
(e) by omitting from subregulation (3)(c) "a newspaper notice" and inserting "notice in a newspaper or on a web site".

These regulations amend the Racing and Gaming Regulations 1976 in respect of –
(a) conditions of telephone sports betting licences; and
(b) advertising by holders of telephone sports betting licences.
