Poisons Amendment (Nursing) Regulations 1998

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment (Nursing) Regulations 1998 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations the Poisons Regulations 1975 are referred to as the Principal Regulations.

4.   Regulation 16B inserted

After regulation 16A of the Principal Regulations, the following regulation is inserted in Division 5 of Part 3:

16B.   Registered nurse may possess and administer narcotic substance

A registered nurse may possess and administer to a person a narcotic substance without instructions from a doctor if –
(a) the nurse is attending an emergency in a remote area and the person requires urgent treatment with medication; and
(b) it is not practicable to obtain instructions from a doctor; and
(c) the nurse has –
(i) undergone an educational program approved by the Nursing Board of Tasmania; and
(ii) been authorised by that Board; and
(d) the nurse follows appropriate procedures approved by the Secretary.

5.   Regulation 37D inserted

After regulation 37C of the Principal Regulations, the following regulation is inserted is Division 3A of Part 4:

37D.   Registered nurse may possess and administer restricted substance

A registered nurse may possess and administer to a person a restricted substance without instructions from a doctor if –
(a) the nurse is attending an emergency in a remote area and the person requires urgent treatment with medication; and
(b) it is not practicable to obtain instructions from a doctor; and
(c) the nurse has –
(i) undergone an educational program approved by the Nursing Board of Tasmania; and
(ii) been authorised by that Board; and
(d) the nurse follows appropriate procedures approved by the Secretary.
