Local Government (Restructuring) Order 1998
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Minister for Local Government, make the following order under sections 12 and 268A of the Local Government Act 1993 .

This order may be cited as the Local Government (Restructuring) Order 1998 .
(1) Clauses 1 , 2 , 3 and 11 take effect on the day on which the making of this order is notified in the Gazette.(2) The remaining provisions of this order take effect on the day on which copies of certificates of the results of the elections to be held on 25 August 1998 are published in the Gazette under section 304 of the Local Government Act 1993.
(1) In this order, a reference to a Plan is a reference to a Plan contained in the Central Plan Register.(2) The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.
4. Abolition of municipal areas and electoral districts
(1) The following municipal areas are abolished:(a) Break O'Day;(b) Brighton;(c) Burnie;(d) Central Coast;(e) Central Highlands;(f) Clarence;(g) Derwent Valley;(h) Devonport;(i) Dorset;(j) George Town;(k) Glamorgan-Spring Bay;(l) Huon Valley;(m) Kentish;(n) Kingborough;(o) Latrobe;(p) Launceston;(q) Meander Valley;(r) Northern Midlands;(s) Sorell;(t) Southern Midlands;(u) Tasman;(v) Waratah-Wynyard;(w) West Tamar.(2) The electoral districts in the municipal area of Launceston are abolished.
The councils of the municipal areas specified in clause 4(1) are abolished.
6. Alteration and definition of boundaries of municipal areas
(1) The boundaries of the municipal area of Glenorchy are altered and defined as indicated by a heavy black line on Plan No. 4104.(2) The boundaries of the municipal area of Hobart are altered and defined as indicated by a heavy black line on Plan No. 4105.(3) The boundaries of the municipal area of West Coast are altered and defined as indicated by a heavy black line on Plan No. 4101.
7. Creation of municipal areas and councils
(1) Municipal areas are created and named as specified in column 1 of the table below and their boundaries are defined as indicated on the plans specified in column 2 of that table:

The number of persons to be elected as councillors in a municipal area specified in column 1 of the following table is the number specified in column 2 of the table next to that municipal area:

(1) The date for elections to be held in the proposed municipal areas specified in clause 7(1) is 25 August 1998.(2) The date for elections to be held in the municipal areas of Flinders and King Island is 25 August 1998.(3) The polling-day for the election to be held in 1998 in the municipal areas of Circular Head, Hobart, Glenorchy and West Coast is 25 August 1998.
12. Local Government (Elections) Order (No. 2) 1998 revoked
The Local Government (Elections) Order (No. 2) 1998 is revoked.
13. Local Government Act 1993 amended

EXPLANATORY NOTE
(This note is not part of the order)
This order (a) abolishes certain municipal areas and electoral districts; and(b) abolishes certain councils; and(c) alters and defines the boundaries of certain municipal areas; and(d) creates and names certain municipal areas and councils; and(e) declares certain municipal areas to be cities; and(f) dismisses councillors of certain councils; and(g) determines the total number of persons to be elected as councillors in each municipal area; and(h) fixes a date for elections to be held; and(i) amends Schedule 3 to the Local Government Act 1993 for the purpose of giving effect to this order; and(j) revokes previous orders.
