I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Miscellaneous) Amendment (Transfer of Interstate Licences) Regulations 1998 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Traffic (Miscellaneous) Regulations 1968 are referred to as the Principal Regulations.

4.   Regulation 50 amended (Fees payable in respect of licences)

Regulation 50 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) "and (3)" and substituting ", (3), (9) and (10)";
(b) by inserting after subregulation (8) the following subregulations:
(9)  If requested to do so by a person who is the holder of a driver's licence issued by another State or Territory, the Registrar may issue an equivalent driver's licence to the person, free of charge.
(10)  A licence issued under subregulation (9) is valid for a period of 5 years or the remaining period of validity of the licence issued by the other State or Territory, whichever is the shorter.

These regulations give effect to Tasmania's commitment to reciprocal driver's licence arrangements between Australian jurisdictions by amending the Traffic (Miscellaneous) Regulations 1968 to allow the Registrar to issue, free of charge, a driver's licence equivalent to one issued by another State or Territory.
