Magistrates Court (Small Claims Division) Amendment Regulations 1998

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Magistrates Court (Small Claims Division) Act 1989 .

1.   Short title

These regulations may be cited as the Magistrates Court (Small Claims Division) Amendment Regulations 1998 .

2.   Commencement

These regulations take effect on 30 March 1998.

3.   Principal Regulations

In these regulations, the Magistrates Court (Small Claims Division) Regulations 1989 are referred to as the Principal Regulations.

4.    Regulation 3A inserted

Before regulation 4 of the Principal Regulations , the following regulation is inserted in Part 2:

3A.   Prescribed sum

For the purpose of paragraph (b) of the definition of "prescribed sum" in section 3 of the Act, the sum of $3 000 is prescribed.

These regulations amend the Magistrates Court (Small Claims Division) Regulations 1989 by prescribing an increased sum for the purpose of the definition of "small claim".
