Libraries Amendment Regulations 1997
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Libraries Act 1984 .

These regulations may be cited as the Libraries Amendment Regulations 1997 .
These regulations take effect on the seventh day after the day on which their making is notified in the Gazette.
In these regulations, the Libraries Regulations 1985 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3 of the Principal Regulations is amended as follows:(a) by omitting "the State Librarian or" from the definition of employee of the State Library Service ;(b) by inserting the following definition after the definition of employee of the State Library Service :library property means land or premises under the care and control of the Secretary for the purposes of the Act;(c) by omitting " regulation 4(5) ." from the definition of Librarycard and substituting " regulation 4(5) ;";(d) by inserting the following definition after the definition of Librarycard :State library means a library of the State Library Service, and includes a mobile library.
5. Regulation 4 amended (Application for Librarycard)
Regulation 4 of the Principal Regulations is amended as follows:(a) by omitting subregulation (3) and substituting the following subregulation:(3) An application made under subregulation (1) by a person who has not attained the age of 18 years is to (a) be signed by a parent, guardian or other adult person having care or control of the applicant; and(b) contain a guarantee by that parent, guardian or other adult person to pay any fees or charges incurred by the applicant.(b) by omitting from subregulation (5) "name of that person" and substituting "name of that person or body".
6. Regulation 8 amended (Retention of books)
Regulation 8 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (2) "14 years" and substituting "18 years";(b) by omitting from subregulation (5) "any charges" and substituting "any processing, accounting or other administrative costs".
7. Regulation 10 amended (Offences)
Regulation 10 of the Principal Regulations is amended as follows:(a) by omitting from each of the following subregulations "land or premises under the care and control of the State Librarian" and substituting "library property": (1)(b), 1(c), (1)(e);(b) by omitting from each of the following subregulations "library under the care and control of the State Librarian" and substituting "State library": (1)(d), (1)(f), (1)(g), (1)(h), (3);(c) by omitting from each of the following subregulations "by the State Librarian" and substituting "by the Secretary": (1)(d), (1)(g), (1)(h);(d) by omitting from subregulation (1) "shall not" and substituting "must not";(e) by omitting from subregulation (1) "0.5 penalty unit" and substituting "2 penalty units";(f) by omitting from subregulation (2) "shall not" and substituting "must not";(g) by omitting from subregulation (2)(b) "library which is under the care and control of the State Librarian" and substituting "State library";(h) by omitting from subregulation (2) "2 penalty units" and substituting "5 penalty units".
8. Regulation 11 substituted
Regulation 11 of the Principal Regulations is rescinded and the following regulation is substituted:11. Parking of vehicles on library property
(1) A person must not park a vehicle on library property unless (a) the person is authorised to do so by the Secretary or by an employee of the State Library Service to whom the Secretary has delegated the power of authorisation for the purposes of this subregulation; or(b) the person is a visitor to, or a user of, the State Library Service and the vehicle is parked in an area of library property designated by the Secretary as a public parking area for a period not exceeding the period specified on the sign erected by the Secretary in respect of that area.Penalty: Fine not exceeding 2 penalty units.(2) An employee of the State Library Service may direct a person who has parked a vehicle in contravention of subregulation (1) to remove the vehicle from library property forthwith or within a period specified by the employee.(3) A person who is given a direction under subregulation (2) must comply with that direction.Penalty: Fine not exceeding 2 penalty units.
The Principal Regulations are further amended by omitting from each of the following regulations "State Librarian" and substituting "Secretary": Regulations 4(1), 4(2)(a), 4(4), 4(5), 5(1), 5(3), 5(4), 5(5), 6, 7, 8(1), 8(2), 8(4) and 9.

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Libraries Regulations 1985 (S.R. 1985, No. 249) by (a) increasing penalties; and(b) replacing, in accordance with current administrative arrangements, references to the former office of State Librarian with references to the Secretary of the Department; and(c) updating certain other references; and(d) simplifying provisions which regulate the parking of vehicles on library property; and(e) imposing stricter requirements on minors who apply for a library card.
