Fisheries Amendment Rules 1997
I make the following rules under the Living Marine Resources Management Act 1995 .

These rules may be cited as the Fisheries Amendment Rules 1997 .
These rules take effect on the day on which their making is notified in the Gazette.
In these rules, the Fisheries Rules 1996 are referred to as the Principal Rules.
4. Rule 3 amended (Interpretation)
Rule 3(1) of the Principal Rules is amended as follows:(a) by omitting "but less than 11 rock lobster pots are" from the definition of rock lobster pot longline and substituting "rock lobster pot is";(b) by inserting the following definition after the definition of sale :scalefish means any species of fish not otherwise defined in these rules;
5. Rule 5 amended (Duration of rules)
Rule 5 of the Principal Rules is amended by omitting "for a period of 12 months" and substituting "until 31 December 1999".
After rule 33 of the Principal Rules, the following rule is inserted in Part 3:33A. Closed and open season for abalone
The Minister, by public notice, may determine (a) the dates of the closed season for all or part of the abalone fishery; and(b) the dates of the open season for all or part of the abalone fishery.
7. Rule 122 amended (Use of tags)
Rule 122 of the Principal Rules is amended by omitting paragraphs (a), (b), (c), (d), (e) and (f) and substituting the following paragraphs:(a) 1 June to 29 June 1997, yellow tag;(b) 30 June to 28 July 1997, orange tag;(c) 29 July to 26 August 1997, dark blue tag;(d) 27 August to 24 September 1997, white tag;(e) 25 September to 23 October 1997, lilac tag;(f) 24 October to 21 November 1997, brown tag.

EXPLANATORY NOTE
(This note is not part of the rule)
These rules amend the Fisheries Rules 1996 by (a) redefining rock lobster pot longline; and(b) prescribing the closed and open seasons for abalone; and(c) prescribing the colour tags to be used as scallop tags during specified periods; and(d) extending the duration of the rules until 31 December 1999.
