Government Prices Oversight (MTT Bus Fares) Order 1997
I make the following order under section 36 of the Government Prices Oversight Act 1995 .

This order may be cited as the Government Prices Oversight (MTT Bus Fares) Order 1997 .
This order takes effect 61 days after the day on which its making is notified in the Gazette.
(1) In this order, unless the contrary intention appears Consumer Price Index means the Consumer Price Index: All Groups Index Number for Hobart published by the Australian Statistician under the Census and Statistics Act 1905 of the Commonwealth;day of last increase, in respect of a particular time, means (a) if the price charged by the Trust for travel on a bus on the scheduled route has not been increased on or after 30 June 1997, that date; or(b) if that price has been so increased on or after that date, the day on which that increase occurred;scheduled route means any bus service provided by the Trust and operating according to a timetable published by the Trust;Trust means the Metropolitan Transport Trust.(2) The Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were by-laws.
At any particular time, the maximum price that may be charged by the Trust for travel on a bus on a scheduled route is determined in accordance with the following formula:Where A is the price charged by the Trust for a ride on a bus on a scheduled route immediately before that particular time; andB is the Consumer Price Index for the quarter ending immediately before that particular time; andC is the Consumer Price Index for the quarter ending immediately before the day of last increase.
5. Metropolitan Transport Act 1954 amended
Section 52 of the Metropolitan Transport Act 1954 is amended as follows:(a) by omitting paragraph (a) from subsection (2) ;(b) by omitting subsections (3) , (4) and (5) .
6. Metropolitan Transport By-laws 1990 amended
(1) Clause 16 of the Metropolitan Transport By-laws 1990 is rescinded.(2) Clause 17 of the Metropolitan Transport By-laws 1990 is amended by omitting all the words after "if" and substituting "the driver of the vehicle is satisfied that the size, weight and contents of the parcel will not cause inconvenience, danger or damage to the vehicle or any passenger on the vehicle.".(3) Clause 18(2) of the Metropolitan Transport By-laws 1990 is amended by omitting all the words after "if" and substituting "the luggage (a) does not weigh more than 26 kilograms; and(b) has dimensions that do not exceed 90 centimetres by 45 centimetres by 30 centimetres.".(4) Schedule 1 to the Metropolitan Transport By-laws 1990 is rescinded.
This order ceases to have effect at the end of the period of 3 years commencing on the day on which the order takes effect.

EXPLANATORY NOTE
(This note is not part of the order)
This order (a) specifies the maximum fares chargeable for the 3 years commencing on 30 June 1997 by the Metropolitan Transport Trust on routes operated by the Trust in accordance with published timetables; and(b) amends the Metropolitan Transport Act 1954 and the Metropolitan Transport By-laws 1990 to remove provisions relating to the setting of fares and the fares chargeable on those routes; and(c) does not specify any maximum price for travel on buses operated by the Trust otherwise than in accordance with published timetables.
