Terrorism Legislation (Extension) Act 2025

An Act to extend the operation of the Police Powers (Public Safety) Act 2005 and the Terrorism (Preventative Detention) Act 2005

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

PART 1 - Preliminary

1.   Short title

This Act may be cited as the Terrorism Legislation (Extension) Act 2025 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

PART 2 - Police Powers (Public Safety) Act 2005 Amended

3.   Principal Act

In this Part, the Police Powers (Public Safety) Act 2005 is referred to as the Principal Act.

4.    Section 34 amended (Expiry of Act)

Section 34(1) of the Principal Act is amended by omitting "31 December 2025" and substituting "31 December 2030".

PART 3 - Terrorism (Preventative Detention) Act 2005 Amended

5.   Principal Act

In this Part, the Terrorism (Preventative Detention) Act 2005 is referred to as the Principal Act.

6.    Section 54 amended (Sunset provision)

Section 54 of the Principal Act is amended as follows:

(a) by omitting from subsection (1) "31 December 2025" and substituting "31 December 2030";

(b) by omitting from subsection (2) "31 December 2025" and substituting "31 December 2030".

PART 4 - Repeal of Act

7.   Repeal of Act

This Act is repealed on the first anniversary of the day on which it commenced.
