Justice Miscellaneous (Reporting Procedures) Act 2025

An Act to amend the Magistrates Court Act 1987, the Registration to Work with Vulnerable People Act 2013 and the Supreme Court Civil Procedure Act 1932

[Royal Assent 16 June 2025]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

PART 1 - Preliminary

1.   Short title

This Act may be cited as the Justice Miscellaneous (Reporting Procedures) Act 2025 .

2.   Commencement

The provisions of this Act commence on a day or days to be proclaimed.

3.   Repeal of Act

This Act is repealed on the first anniversary of the day on which the last uncommenced provision of this Act commenced.
PART 2 - Magistrates Court Act 1987 Amended

4.   Principal Act

In this Part, the Magistrates Court Act 1987 is referred to as the Principal Act.

5.    Section 17C amended (Annual report)

Section 17C(1) of the Principal Act is amended by omitting "30 November" and substituting "31 October".
PART 3 - Registration to Work with Vulnerable People Act 2013 Amended

6.   Principal Act

In this Part, the Registration to Work with Vulnerable People Act 2013 is referred to as the Principal Act.

7.    Section 53AB inserted

After section 53A of the Principal Act , the following section is inserted in Part 7A:

53AB.   Persons may notify Registrar of reportable behaviour

(1)  A person may notify the Registrar of reportable behaviour if the person making the notification –
(a) becomes aware by any means, or suspects on reasonable grounds, that another person has engaged, or may have engaged, in reportable behaviour; and
(b) believes, on reasonable grounds, that the other person –
(i) is a registered person; or
(ii) has applied for registration under this Act.
(2)  A notification under subsection (1) in respect of reportable behaviour is to include, as far as it is known by the person making the notification –
(a) the name of, and any other identifying particulars of, the person who engaged, or may have engaged, in the behaviour; and
(b) details of the alleged reportable behaviour.
(3)  For the avoidance of doubt, a person may make a notification under subsection (1) in respect of reportable behaviour that occurred, or that the person was aware of, before the commencement of this Act.

8.    Section 60 amended (Regulations)

Section 60(2)(db)(i) of the Principal Act is amended by omitting "by a reporting body".
PART 4 - Supreme Court Civil Procedure Act 1932 Amended

9.   Principal Act

In this Part, the Supreme Court Civil Procedure Act 1932 is referred to as the Principal Act.

10.    Section 194H amended (Annual report)

Section 194H(1) of the Principal Act is amended by omitting "30 November" and substituting "31 October".
