Land Use Planning and Approvals Amendment (Sensitive Disclosures) Act 2025
An Act to amend the Land Use Planning and Approvals Act 1993

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
This Act may be cited as the Land Use Planning and Approvals Amendment (Sensitive Disclosures) Act 2025 .
This Act commences on the day on which this Act receives the Royal Assent.
In this Act, the Land Use Planning and Approvals Act 1993 is referred to as the Principal Act.
4. Section 60BA amended (Information about sensitive matters)
Section 60BA of the Principal Act is amended as follows:(a) by inserting the following subsection after subsection (1) :(1A) As soon as practicable after the commencement of this subsection, a proponent of a project must make to each relevant regulator a sensitive matters request in relation to the project if (a) the project was declared to be a major project under section 60O(1) before 17 May 2023; and(b) a decision has not yet been made under section 60ZZM(1) in respect of the major project.(b) by inserting in subsection (2)(a)(i) "or subsection (1A) " after " (c) ";(c) by omitting from subsection (2)(c) "requesting the relevant regulator" and substituting "subject to subsection (2A), requesting the relevant regulator";(d) by inserting the following subsection after subsection (2) :(2A) The proponent of a project referred to in subsection (1A), when making a request to the relevant regulator for the purposes of subsection (2)(c), is not required to request any advice from the relevant regulator in relation to whether sensitive matter is likely to be contained in any category of information that, before the commencement of this subsection, was provided by the proponent, under this Division, to the Panel or a person.
This Act is repealed on the first anniversary of the day on which it commenced.
