An Act to amend the Tasmanian Development Act 1983

[Royal Assent 5 September 2024]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Tasmanian Development Amendment Act 2024 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Tasmanian Development Act 1983 is referred to as the Principal Act.

4.    Section 9 amended (General powers of TDR)

Section 9 of the Principal Act is amended as follows:
(a) by omitting from subsection (2)(b) "$3 000 000" and substituting "$15 000 000";
(b) by omitting from subsection (2)(d) "$10 000 000" and substituting "$35 000 000";
(c) by omitting from subsection (4)(a) "$250 000" and substituting "$500 000";
(d) by omitting from subsection (4)(b) "$20 000" and substituting "$50 000";
(e) by inserting the following subsection after subsection (6) :
(7)  An amendment made, by the Tasmanian Development Amendment Act 2024, to an amount specified in a provision of this section does not prevent that amount, or any other amount, from being amended or further amended by an order made in accordance with subsection (6) .

5.    Section 37 amended (Powers of Governor as to loans, grants, and guarantees)

Section 37 of the Principal Act is amended by omitting subsection (5) .

6.    Section 37A inserted

After section 37 of the Principal Act , the following section is inserted in Part III:

37A.   Funding of grants and loans under this Part

(1)  A grant or loan of money under this Part may be paid from –
(a) money appropriated by Parliament for the purpose; or
(b) the funds of TDR, as determined by the Treasurer.
(2)  For the avoidance of doubt, the funding of a grant or loan under this Part is a purpose for which TDR may borrow money under section 24 .
(3)  A grant or loan that was granted or made, under this Part, before the commencement of the Tasmanian Development Amendment Act 2024 is not invalid solely on the basis that it was paid from –
(a) the funds of TDR; or
(b) money appropriated by Parliament for the purpose.

7.    Section 38A inserted

After section 38 of the Principal Act , the following section is inserted in Part IV:

38A.   Delegation by Minister

The Minister may delegate, in writing, any of the administrative or managerial functions, or powers, of the Minister under this Act, other than this power of delegation.

8.   Repeal of Act

This Act is repealed on the first anniversary of the day on which it commenced.
