Aboriginal Relics (Consequential Amendments) Act 2017
An Act to make amendments consequent on the enactment of the Aboriginal Relics Amendment Act 2017
Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
PART 1 - Preliminary
This Act may be cited as the Aboriginal Relics (Consequential Amendments) Act 2017 .
This Act commences on the day on which the Aboriginal Relics Amendment Act 2017 commences.
PART 2 - Crown Lands (Shack Sites) Act 1997 Amended
In this Part, the Crown Lands (Shack Sites) Act 1997 is referred to as the Principal Act.
4. Schedule 2A amended (Model conversion criteria)
Clause 1(1)(a) of Schedule 2A to the Principal Act is amended by omitting " Aboriginal Relics Act 1975 " and substituting " Aboriginal Heritage Act 1975 ".
PART 3 - Crown Lands Regulations 2011 Amended
In this Part, the Crown Lands Regulations 2011 are referred to as the Principal Regulations.
6. Regulation 19 amended (Restrictions relating to public reserves)
Regulation 19(3)(a) of the Principal Regulations is amended by omitting " Aboriginal Relics Act 1975 " and substituting " Aboriginal Heritage Act 1975 ".
PART 4 - Museums (Aboriginal Remains) Act 1984 Amended
In this Part, the Museums (Aboriginal Remains) Act 1984 is referred to as the Principal Act.
8. Section 8 amended (Cremation of remains not to be an offence for purposes of certain Acts)
Section 8 of the Principal Act is amended by omitting paragraph (b) and substituting the following paragraph:(b) section 14(1)(a) of the Aboriginal Heritage Act 1975;
PART 5 - National Broadband Network (Tasmania) Act 2010 Amended
In this Part, the National Broadband Network (Tasmania) Act 2010 is referred to as the Principal Act.
10. Section 28 amended (Application of planning laws)
Section 28(b) of the Principal Act is amended by omitting " Aboriginal Relics Act 1975 " and substituting " Aboriginal Heritage Act 1975 ".
PART 6 - Port Arthur Historic Site Management Authority Act 1987 Amended
In this Part, the Port Arthur Historic Site Management Authority Act 1987 is referred to as the Principal Act.
12. Section 12 amended (Co-ordination of administration with requirements of Nature Conservation Act 2002 )
Section 12(1)(b) of the Principal Act is amended by omitting " Aboriginal Relics Act 1975 " and substituting " Aboriginal Heritage Act 1975 ".
PART 7 - Wellington Park Regulations 2009 Amended
In this Part, the Wellington Park Regulations 2009 are referred to as the Principal Regulations.
14. Regulation 26 amended (Relics)
Regulation 26(2) of the Principal Regulations is amended by omitting "has in section 2(3) of the Aboriginal Relics Act 1975 " from the definition of Aboriginal relic and substituting "has in the Aboriginal Heritage Act 1975 ".
PART 8 - Repeal of Act
This Act is repealed on the three hundred and sixty fifth day from the day on which it commences.
