Teachers Registration Amendment Act 2016
An Act to amend the Teachers Registration Act 2000
[Royal Assent 7 October 2016]
Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
PART 1 - Preliminary
This Act may be cited as the Teachers Registration Amendment Act 2016 .
(1) Part 1 and Part 2 commence on the day on which this Act receives the Royal Assent.(2) The remaining provisions of this Act commence on 1 January 2017.
This Act is repealed on the three hundred and sixty fifth day from the day on which all of the provisions of this Act commence.
PART 2 - Teachers Registration Act 2000 Amended
In this Part, the Teachers Registration Act 2000 is referred to as the Principal Act.
5. Section 17J amended (Determining whether person of good character)
Section 17J of the Principal Act is amended by inserting after paragraph (a) the following paragraph:(ab) is to take into account (i) whether the person has been refused registration under the Registration to Work with Vulnerable People Act 2013 ; and(ii) if the person is, or has been, registered under that Act, whether the registration has been suspended or cancelled; and
PART 3 - Teachers Registration Act 2000 Further Amended
In this Part, the Teachers Registration Act 2000 is referred to as the Principal Act.
7. Section 13 amended (Determination of application for registration)
Section 13 of the Principal Act is amended as follows:(a) by inserting the following paragraph after paragraph (c) in subsection (2) :(ca) the applicant is registered under the Registration to Work with Vulnerable People Act 2013 in respect of a regulated activity, within the meaning of that Act, that primarily relates to children;(b) by inserting the following paragraph after paragraph (c) in subsection (3) :(ca) the applicant is registered under the Registration to Work with Vulnerable People Act 2013 in respect of a regulated activity, within the meaning of that Act, that primarily relates to children;(c) by inserting the following paragraph after paragraph (c) in subsection (3A) :(ca) the applicant is registered under the Registration to Work with Vulnerable People Act 2013 in respect of a regulated activity, within the meaning of that Act, that primarily relates to children;
8. Section 17A amended (Renewal of full registration and specialist vocational education and training registration)
Section 17A(3) of the Principal Act is amended by inserting after paragraph (b) the following paragraph:(ba) satisfied that the person is registered under the Registration to Work with Vulnerable People Act 2013 in respect of a regulated activity, within the meaning of that Act, that primarily relates to children; and
9. Section 17D amended (Determination of application)
Section 17D(2) of the Principal Act is amended by inserting after paragraph (b) the following paragraph:(ba) is registered under the Registration to Work with Vulnerable People Act 2013 in respect of a regulated activity, within the meaning of that Act, that primarily relates to children; and
