State Service Legislation (Miscellaneous Amendments) Act 2016

An Act to amend the Building and Construction Industry Training Fund Act 1990 , the Ombudsman Act 1978 , the Personal Information Protection Act 2004 , the Public Interest Disclosures Act 2002 , the Right to Information Act 2009 , the Tasmanian Development Act 1983 and the Threatened Species Protection Act 1995

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the State Service Legislation (Miscellaneous Amendments) Act 2016 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Consequential amendments

The legislation specified in Schedule 1 is amended as specified in that Schedule.

4.   Repeal of Act

This Act is repealed on the three hundred and sixty fifth day from the day on which it commences.

SCHEDULE 1 - Consequential Amendments

Section 3

1.    Section 13(10) is amended by omitting "State Service Commissioner" and substituting "Minister administering the State Service Act 2000 ".

1.    Clause 5 of Schedule 2 is amended by omitting "State Service Commissioner" and substituting "Tasmanian Industrial Commission".

1.    Section 20 is amended as follows:

(a) by omitting from subsection (1) ", subject to subsection (3) ,";

(b) by omitting subsection (3) .

1.    Section 7 is amended as follows:

(a) by omitting from subsection (1)(c) ", the Ombudsman or the State Service Commissioner" and substituting "or the Ombudsman";

(b) by omitting subsection (5C) .

2.    Section 15(2) is amended by omitting paragraph (d) .

3.    Section 23(1)(a) is amended by omitting "the State Service Commissioner,".

4.    Part 4 is repealed.

5.    Section 30 is amended by omitting subsection (3) .

6.    Section 33 is amended by omitting subsection (3) .

7.    Section 87(1) is amended by omitting paragraph (d) .

8.    Section 88(1) is amended by omitting "the State Service Commissioner,".

1.    Section 6(1) is amended by omitting paragraph (l) .

1.    Section 32(9) is amended by omitting "Commissioner for Public Employment" and substituting "Minister administering the State Service Act 2000 ".

2.    Section 33(3) is amended as follows:

(a) by omitting "State Service Commissioner" and substituting "Minister administering the State Service Act 2000 ";

(b) by inserting "or employee" after "that officer".

1.    Clause 4 of Schedule 2 is amended by omitting "Commissioner for Public Employment" and substituting "Minister administering the State Service Act 2000 ".
