Anti-Discrimination Amendment Act 2015
An Act to amend the Anti-Discrimination Act 1998
[Royal Assent 24 June 2015]
Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
This Act may be cited as the Anti-Discrimination Amendment Act 2015 .
This Act commences on the day on which this Act receives the Royal Assent.
In this Act, the Anti-Discrimination Act 1998 is referred to as the Principal Act.
4. Section 3 amended (Interpretation)
Section 3 of the Principal Act is amended by inserting ", guardian, within the meaning of the Children, Young Persons and Their Families Act 1997 " after "adoptive parent" in the definition of parent .
5. Section 51A inserted
After section 51 of the Principal Act , the following section is inserted in Division 8:51A. Admission of person as student based on religion
(1) A person may discriminate against another person on the ground of religious belief or affiliation or religious activity in relation to admission of that other person as a student to an educational institution that is or is to be conducted in accordance with the tenets, beliefs, teachings, principles or practices of a particular religion.(2) Subsection (1) does not apply to a person who is enrolled as a student at the educational institution referred to in that subsection.(3) Subsection (1) does not permit discrimination on any grounds referred to in section 16 other than those specified in that subsection.(4) A person may, on a ground specified in subsection (1) , discriminate against another person in relation to the admission of the other person as a student to an educational institution, if the educational institution's policy for the admission of students demonstrates that the criteria for admission relates to the religious belief or affiliation, or religious activity, of the other person, the other person's parents or the other person's grandparents.
6. Sections 55A and 55B repealed
Sections 55A and 55B of the Principal Act are repealed.
This Act is repealed on the three hundred and sixty fifth day from the day on which it commences.
