Charter of Budget Responsibility Amendment Act 2011

An Act to amend the Charter of Budget Responsibility Act 2007

[Royal Assent 25 October 2011]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Charter of Budget Responsibility Amendment Act 2011 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Charter of Budget Responsibility Act 2007 is referred to as the Principal Act.

4.    Schedule 1 amended (Charter of Budget Responsibility)

Schedule 1 to the Principal Act is amended as follows:
(a) by omitting "starting with the issue of the writ for the election" from the definition of caretaker period in clause 2(1) of Part 2 and substituting "commencing on the dissolution of the House of Assembly";
(b) by inserting the following definition after the definition of caretaker period in clause 2(1) of Part 2 :
day means a day other than a non-business day;
(c) by inserting the following definitions after the definition of Leader of an Opposition party in clause 2(1) of Part 2 :
non-business day means a Saturday, Sunday, statutory holiday as defined in the Statutory Holidays Act 2000 or a public holiday throughout the State;
polling day means a day, including a non-business day, on which an election for the House of Assembly is held;
(d) by omitting from clause 6 of Part 4 "of the issue of a writ for an election for the House of Assembly" and substituting "of the commencement of the caretaker period";
(e) by omitting from clause 10(1) of Part 5 "of the issue of a writ for an election for the House of Assembly" and substituting "of the commencement of the caretaker period";
(f) by omitting from clause 10(3) of Part 5 "of the issue of the writ for the election for the House of Assembly" and substituting "of the commencement of the caretaker period";
(g) by omitting from clause 11(1) of Part 5 "the issue of a writ for an election for the House of Assembly" and substituting "the commencement of the caretaker period";
(h) by omitting from clause 11(2) of Part 5 "of the issue of the writ for an election for the House of Assembly" and substituting "of the commencement of the caretaker period".

5.   Repeal of Act

This Act is repealed on the ninetieth day from the day on which it commences.
