Anti-Discrimination Amendment Act 2001

An Act to amend the Anti-Discrimination Act 1998

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Anti-Discrimination Amendment Act 2001 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Anti-Discrimination Act 1998 is referred to as the Principal Act.

4.    Section 3 amended (Interpretation)

Section 3 of the Principal Act is amended by inserting after the definition of discrimination the following definition:

educational institution means a school, college or university;

5.   Section 51 amended (Employment based on religion)

Section 51 of the Principal Act is amended as follows:

(a) by omitting "A person" and substituting "(1) A person";

(b) by inserting the following subsection:

(2)  A person may discriminate against another person on the ground of religious belief or affiliation or religious activity in relation to employment in an educational institution that is or is to be conducted in accordance with the tenets, beliefs, teachings, principles or practices of a particular religion if the discrimination is in order to enable, or better enable, the educational institution to be conducted in accordance with those tenets, beliefs, teachings, principles or practices.
