Taxi Industry Amendment Act 1999

An Act to amend the Taxi Industry Act 1995

[Royal Assent 27 October 1999]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Taxi Industry Amendment Act 1999 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Taxi Industry Act 1995 is referred to as the Principal Act.

4.    Section 3 amended (Interpretation)

Section 3 of the Principal Act is amended by omitting the definition of Board .

5.    Part 2, Division 2 repealed

Division 2 of Part 2 of the Principal Act is repealed.

6.    Section 14A amended (Refunds from special fund for Hobart taxi area)

Section 14A of the Principal Act is amended as follows:
(a) by omitting subsection (7) ;
(b) by omitting from subsection (17) "or the Board".

7.    Section 19 amended (Issue of perpetual taxi licences)

Section 19(2) of the Principal Act is amended as follows:
(a) by omitting from paragraph (b) "value –" and substituting "value.";
(b) by omitting "and, in making a determination, the Commission must take into account any advice given by the Board.".

8.    Section 23 amended (Temporary taxi licences)

Section 23(1) of the Principal Act is amended by omitting ", after taking into account the advice of the Board,".

9.    Section 26 amended (Information as to taxi industry)

Section 26 of the Principal Act is amended by omitting ", in consultation with the Board,".

10.    Section 27 amended (Regulations)

Section 27(4) of the Principal Act is amended by omitting "the Board and".

11.   Schedules 1 and 2 repealed

Schedules 1 and 2 to the Principal Act are repealed.

12.    Taxi Industry Regulations 1996 amended

Schedule 3 to the Taxi Industry Regulations 1996 is amended by omitting Form 2 and substituting:
