Poisons (Interim Authorisation) Order 2023

I make the following order under section 25D(1) of the Poisons Act 1971 .

1.   Short title

This order may be cited as the Poisons (Interim Authorisation) Order 2023 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –
Act means the Poisons Act 1971 .

4.   Declaration of authorised health professionals and authorised body

(1)  For the purposes of the Act, pharmacists are declared to be a class of health professionals that are authorised health professionals.
(2)  The department responsible for the administration of the Act is declared to be the authorised body in respect of authorised health professionals that are pharmacists.

5.   Authorisation in relation to pharmacists

A pharmacist, in the lawful practice of the pharmacist’s profession, is authorised to possess, sell, supply or prescribe a scheduled substance, subject to the following conditions:
(a) that the possession, sale, supply or prescribing of the scheduled substance is in accordance with section 25C(2) of the Act;
(b) that the scheduled substance is only prescribed in accordance with –
(i) a treatment plan, in respect of a specific patient, that is produced by a medical practitioner; or
(ii) a protocol, in relation to the prescribing of that substance by a pharmacist, published by the department responsible for the administration of the Act.

6.   Expiry of order

In accordance with section 25D(2) of the Act, this order is revoked at the end of the period of 6 months commencing on the day on which it takes effect.
