State Policies and Projects (Validation of Actions) Act 2001

An Act to validate certain actions taken by the Premier and the Resource Planning and Development Commission under the State Policies and Projects Act 1993

[Royal Assent 26 April 2001]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the State Policies and Projects (Validation of Actions) Act 2001 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Validation of certain actions taken by the Premier and the Resource Planning and Development Commission

(1)  Any action taken by the Premier from 18 September 1998 to 10 April 2001 in the performance of a function or exercise of a power under the State Policies and Projects Act 1993 that should have been taken by the Minister for Primary Industries, Water and Environment is deemed to have been validly taken.
(2)  Any action taken by the Resource Planning and Development Commission or a delegate of the Commission from 18 September 1998 to 10 April 2001 –
(a) pursuant to any action referred to in subsection (1) ; or
(b) in reporting, providing advice, making recommendations or forwarding submissions to the Premier in the performance of a function or exercise of a power under the State Policies and Projects Act 1993  –
is deemed to have been validly taken.

4.   Administration of Act

Until provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  –
(a) the administration of this Act is assigned to the Premier; and
(b) the department responsible to the Premier in relation to the administration of this Act is the Department of Premier and Cabinet.
