Ex-Servicemen's Badges Act 1967

An Act to prohibit the unauthorized use or possession of membership badges issued by ex-servicemen's associations

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Ex-Servicemen's Badges Act 1967 .

2.   Interpretation

In this Act, unless the contrary intention appears –

association means an ex-servicemen's association declared by proclamation to be an association to which this Act applies;

ex-servicemen's badge means a badge of the kind issued by an association for the purpose of indicating that the wearer is a member of that association;

financial member means a member of an association who has paid and continues to pay annually the subscription required by that association to be paid by its members, and includes a member who has not paid such subscription except where such subscription remains unpaid at the expiration of a period of 3 months after having become due.

3.   Unauthorized use or possession of badges

(1)  No person who is not a financial member of an association shall wear, or, without lawful excuse, have in his possession, an ex-servicemen's badge of that association.

(2)  [Section 3 Subsection (2) amended by No. 43 of 1991, s. 5 and Sched. 1 ]A person who contravenes any of the provisions of this section is guilty of an offence.

Penalty:  For a first offence, a fine not exceeding 1 penalty unit; for a subsequent offence, a fine not exceeding 3 penalty units.
