Traffic (Compliance and Enforcement) Regulations 2017

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Compliance and Enforcement) Regulations 2017 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

(1)  In these regulations –
Act means the Traffic Act 1925 ;

[Regulation 3 Subregulation (1) amended by S.R. 2021, No. 29, Applied:01 Jun 2021] DLVR means the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 ;
[Regulation 3 Subregulation (1) amended by S.R. 2018, No. 57, Applied:20 Sep 2018] LHCIR means the Luxury Hire Car Industry Regulations 2018 ;
MALC means the Motor Accidents (Liabilities and Compensation) Act 1973 ;
PTSA means the Passenger Transport Services Act 2011 ;
PTSR means the Passenger Transport Services Regulations 2013 ;
RHVIR means the Restricted Hire Vehicle Industry Regulations 2013 ;

TA means the Traffic Act 1925 ;
THVIA means the Taxi and Hire Vehicle Industries Act 2008 ;
[Regulation 3 Subregulation (1) amended by S.R. 2018, No. 57, Applied:20 Sep 2018] TIR means the Taxi Industry Regulations 2018 ;
VOR means the Vehicle and Traffic (Vehicle Operations) Regulations 2014 ;
VSR means the Vehicle and Traffic (Vehicle Standards) Regulations 2014 (known as the Vehicle Standards);
VT means the Vehicle and Traffic Act 1999 .
(2)  A reference in Schedule 1 to an Act or to any regulations, followed immediately by a number, is a reference to the provision of that Act or those regulations that is so numbered.

4.   Prescribed offences for section 9(3) of Act

[Regulation 4 Substituted by S.R. 2021, No. 29, Applied:01 Jun 2021] For section 9(3) of the Act, a parking offence is a prescribed offence.

5.   Prescribed offences for section 43H of Act

For the purposes of section 43H(6A) of the Act, the following are prescribed offences:
(a) a parking offence;
(b) a speeding offence;
(c) [Regulation 5 Amended by S.R. 2021, No. 29, Applied:01 Jun 2021] an offence under regulation 12(2) or (3) of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 .

6.   Prescribed offences for Part IVB of Act

For Part IVB of the Act –
(a) the offences specified in column 2 of Parts 1 , 2 , 3 , 4 and 5 of Schedule 1 are prescribed; and
(b) the description of each prescribed offence is specified for the offence in column 3 of Parts 1 , 2 , 3 , 4 and 5 of Schedule 1 for illustrative purposes only; and
(c) the penalty units and demerit points applicable to each of the prescribed offences are as respectively specified for the offence in columns 4 and 5 of Parts 1 , 2 , 3 , 4 and 5 of Schedule 1 .

7.   Specified offences for section 54(1AA) of Act

For section 54(1AA) of the Act, the following offences are specified:
(a) a parking offence;
(b) a red light offence, or speeding offence, detected by means of a photographic detection device;
(c) [Regulation 7 Amended by S.R. 2021, No. 29, Applied:01 Jun 2021] an offence under section 27(1) of the Vehicle and Traffic Act 1999 .

8.   Prescribed authorities for section 59 of Act

The following authorities are prescribed authorities for the purposes of section 59(1A)(b) of the Act:
(a) Aurora Energy Pty Ltd;
(b) Forestry Tasmania;
(c) Tasmania Water and Sewerage Corporation Pty Limited;
(d) Telstra Corporation Limited;
(e) the department responsible for the administration of the Environmental Management and Pollution Control Act 1994 ;
(f) the department responsible for the administration of the Nature Conservation Act 2002 ;
(g) the department responsible for the administration of the National Parks and Reserves Management Act 2002 ;
(h) the department responsible for the administration of the Water Management Act 1999 ;
(i) Transend Networks Pty Ltd.

9.   Legislation rescinded

The legislation specified in Schedule 2 is rescinded.
