I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Births, Deaths and Marriages Registration Act 1999 .

1.   Short title

These regulations may be cited as the Births, Deaths and Marriages Registration Regulations 2010 .

2.   Commencement

These regulations take effect on 11 October 2010.

3.   Fees

The fees set out in Schedule 1 are prescribed as the fees that are payable under the Births, Deaths and Marriages Registration Act 1999 in respect of the matters to which they respectively relate.

4.   Prescribed persons for section 28E of Act

(1)  In these regulations –
registered person means a person whose change of sex is registered under Part 4A of the Births, Deaths and Marriages Registration Act 1999 .
(2)  For the purposes of section 28E of the Act, each of the following is a prescribed person:
(a) the registered person;
(b) the spouse, or a former spouse, of the registered person;
(c) the person who is or has been in a significant relationship, within the meaning of the Relationships Act 2003 , with the registered person;
(d) a parent of the registered person (with, if the registered person has attained the age of 18 years, the written consent of the registered person);
(e) an executor or administrator of the registered person's estate;
(f) a person who holds a power of attorney of the registered person;
(g) an agent of the registered person (with the written consent of the registered person);
(h) an officer or person acting on behalf of a state or federal law enforcement body, including a court.

A search of the Register in any one name (including the issue of the relevant document) –

 
 

(a) for a period not exceeding 5 years; and

(b) for each additional 5-year period or part of such a period

The issue of a certificate (in addition to the search fee)

The issue of a medical practitioner's certificate of cause of death (in addition to the search fee)

A certified copy of an entry not otherwise provided for

Family history searching service, for each 20-minute period or part of such a period

An application to register a change of name, including noting the new name in the Register in this State, or advising the relevant registry in another State in which the person's birth is registered, and the issue of a change of name certificate

An application for the amendment of information in the Register not otherwise provided for (not including the issue of a replacement certificate)

The addition to the Register of details of either parent or of his or her marriage –

 
 

(a) if application is made by both parents; or
