Environmental Management and Pollution Control (Environmental Infringement Notices) Regulations 2016
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .

These regulations may be cited as the Environmental Management and Pollution Control (Environmental Infringement Notices) Regulations 2016 .
These regulations take effect on 30 August 2016.
In these regulations, unless the contrary intention appears Act means the Environmental Management and Pollution Control Act 1994 .
(1) For the purposes of section 72 of the Act (a) an offence under a provision of an Act or regulations specified in Schedule 1 or 3 is a prescribed offence; and(b) an offence under section 53(2) of the Act constituted by conduct specified in Schedule 2 is a prescribed offence.(2) The penalty specified in column 2 of opposite a prescribed offence is the penalty applicable to that offence.(a) item 1 or 2 of Schedule 1 ; or(b) Schedule 2 ; or(c) Schedule 3 (3) The penalty specified in item 3 of Schedule 1 in relation to a prescribed offence is (a) in the case of an environmental infringement notice issued to an individual, the penalty for that offence that is specified in column 2 opposite that offence; and(b) in the case of an environmental infringement notice issued to a body corporate, the penalty for that offence that is specified in column 3 opposite that offence.

SCHEDULE 2 - Offences under Section 53(2) of Act Constituted by Specified Conduct
