Food Regulations 2003
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Food Act 2003 .

These regulations may be cited as the Food Regulations 2003 .
These regulations take effect on the day on which the Food Act 2003 commences.
In these regulations,[Regulation 3 Amended by S.R. 2007, No. 62, Applied:01 Aug 2007] Act means the Food Act 2003 ;[Regulation 3 Amended by S.R. 2007, No. 62, Applied:01 Aug 2007] Seafood Standard means the Primary Production and Processing Standard for Seafood contained in chapter 4.2.1 of the Food Standards Code.[Regulation 3 Amended by S.R. 2007, No. 62, Applied:01 Aug 2007] Seafood Standard means the Primary Production and Processing Standard for Seafood contained in chapter 4.2.1 of the Food Standards Code.
4. Incorporation of Food Standards Code
The Food Standards Code, as in force from time to time, is incorporated in these regulations.[Regulation 4 Inserted by S.R. 2008, No. 118, s. 4, Applied:01 Oct 2008]
5. Meaning of appropriate enforcement agency in Food Standards Code
The Director of Public Health or a council is the appropriate enforcement agency for the purposes of the Food Standards Code.
5A. Application fee for approval of food safety auditors
[Regulation 5A Inserted by S.R. 2009, No. 134, Applied:02 Dec 2009] For section 83A(3)(b) of the Act, the prescribed fee is 116 fee units.
6. Infringement notice offences
(1) The offences that are created by the sections of the Act specified in Column 2 of the table in Schedule 1 are prescribed offences for the purposes of section 118 of the Act.(2) [Regulation 6 Subregulation (2) amended by No. 72 of 2007, Sched. 1, Applied:28 Apr 2008] For the purposes of the Act, the prescribed penalty for each of those prescribed offences is the penalty specified opposite that offence in Column 4 of the table in Schedule 1 .
[Regulation 6A Inserted by S.R. 2007, No. 62, Applied:01 Aug 2007] For the purposes of section 7(2) of the Act, the definition of "primary food production" in the Act does not include the following food production activities:(a) primary production of seafood, as defined in clause 2 of the Seafood Standard;(b) processing of seafood, as defined in clause 2 of the Seafood Standard.
[Regulation 6A Inserted by S.R. 2007, No. 62, Applied:01 Aug 2007] For the purposes of section 7(2) of the Act, the definition of "primary food production" in the Act does not include the following food production activities:(a) primary production of seafood, as defined in clause 2 of the Seafood Standard;(b) processing of seafood, as defined in clause 2 of the Seafood Standard.
The Statutory Rules specified in Schedule 2 are rescinded.
