Sale of Hazardous Goods (Lead in Children's Toys) Order 2008

The Products Safety Committee makes the following order under section 8 of the Sale of Hazardous Goods Act 1977 .

1.   Short title

This order may be cited as the Sale of Hazardous Goods (Lead in Children's Toys) Order 2008 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –
accessible material means any part of a child's toy that has a reasonable probability of coming into contact with a child's mouth;
Toy Safety Standard means the Australian and New Zealand Standard AS/NZS ISO 8124.3:2003 entitled "Safety of toys – Part 3: Migration of certain elements" published by Standards Australia and Standards New Zealand on 23 May 2003 as in force on the day this order takes effect.

4.   Prohibition on sale of toys containing specified amounts of lead

A person must not sell a child's toy that has accessible material with a lead migration level greater than 90 milligrams per kilogram of lead when tested in accordance with the testing procedures and interpretation of results specified in the Toy Safety Standard.

This order was made by the Products Safety Committee at a meeting held on 19 March 2008.
