Trans-Tasman Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 6 of the Trans-Tasman Mutual Recognition (Tasmania) Act 2003 .

1.   Short title

These regulations may be cited as the Trans-Tasman Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007 .

2.   Commencement

These regulations take effect on 1 August 2007.

3.   Interpretation

In these regulations, unless the contrary intention appears –

State Act means the Trans-Tasman Mutual Recognition (Tasmania) Act 2003 ;

tobacco product means tobacco product as defined in the Public Health Act 1997 .

4.   Temporary exemptions for tobacco products

For the purposes of section 46 of the Commonwealth Act as adopted by the State Act –

(a) goods that are tobacco products are declared to be exempt from the operation of the Commonwealth Act; and

(b) the Public Health Act 1997 , to the extent that it deals with tobacco products, is declared to be a law that is exempt from the operation of the Commonwealth Act.

5.   Expiry

These regulations expire on 31 July 2008.
