Government Prices Oversight (Metro Bus Fares) Order 2006

I make the following order under section 36 of the Government Prices Oversight Act 1995 .

1.   Short title

This order may be cited as the Government Prices Oversight (Metro Bus Fares) Order 2006 .

2.   Commencement

This order takes effect 61 days after the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this order, unless the contrary intention appears –
Agreement means –
(a) the agreement, as amended from time to time, in respect of the provision of scheduled route services made on 30 June 2001 between the Crown (in right of the State of Tasmania) and Metro Tasmania Pty. Ltd., signed on behalf of the Crown by The Honourable Paul Anthony Lennon MHA, and on behalf of Metro Tasmania Pty. Ltd. by the Chairperson of the Metro Board; or
(b) an agreement, as amended from time to time, in respect of scheduled route services between the Crown (in right of the State of Tasmania) and Metro Tasmania Pty. Ltd. that replaces or supersedes the agreement referred to in paragraph (a) ;
first year means the period of 12 months commencing on the day on which this order takes effect;
full adult fares means the fares to be charged to full fare-paying adult passengers for single-ride tickets and multi-ride tickets;
Metro means Metro Tasmania Pty. Ltd.;
scheduled route services means the regular passenger transport services specified in the Agreement as comprising the Community Service Activity that Metro is contracted to deliver;
second year means the period of 12 months commencing on the first anniversary of the day on which this order takes effect;
third year means the period of 12 months commencing on the second anniversary of the day on which this order takes effect.
(2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were regulations.

4.   Scope of order

This order specifies the maximum full adult fares that Metro may charge for travel on scheduled route services.

5.   Maximum full adult fare

(1)  A full adult fare charged by Metro at any time during the first year must not exceed the amount specified in column 1 of Schedule 1 .
(2)  A full adult fare charged by Metro at any time during the second year must not exceed the amount specified in column 2 of Schedule 1 .
(3)  A full adult fare charged by Metro at any time during the third year must not exceed the amount specified in column 3 of Schedule 1 .

6.   Expiry

This order ceases to have effect at the end of the period of 3 years commencing on the day on which this order takes effect.

7.   Legislation revoked

The legislation specified in Schedule 2 is revoked.
