Daylight Saving Act 1968

An Act to promote the earlier use of daylight in certain months yearly and to provide for matters incidental thereto

[Royal Assent 15 October 1968]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Daylight Saving Act 1968 .

2.   Interpretation

In this Act, unless the contrary intention appears –
standard time means the time declared by the Standard Time Act 1895 to be standard time throughout this State;
Tasmanian summer time means the time to be observed throughout this State as prescribed by this Act.

3.   Advance of time

(1)  [Section 3 Subsection (1) amended by No. 55 of 1981, s. 3 ][Section 3 Subsection (1) amended by No. 25 of 1972, s. 2 ]Notwithstanding anything in the Standard Time Act 1895 , from the hour of 2 a.m. of the last Sunday in the month of October in each year (from and including the year 1968) until the hour of 2 a.m. of the first Sunday of March in the next following year, Tasmanian summer time shall, throughout the State, be one hour in advance of standard time, and shall be observed accordingly.
(1A)  [Section 3 Subsection (1A) inserted by No. 16 of 1986, s. 3 ]The Governor may, by order, vary the period referred to in subsection (1) and Tasmanian summer time, as prescribed by subsection (1) , shall be observed throughout the State during that period as varied.
(1B)  [Section 3 Subsection (1B) inserted by No. 16 of 1986, s. 3 ]The period referred to in subsection (1) may not be varied under subsection (1A) , if that period as varied –
(a) would commence earlier than the hour of 2 a.m. of the first Sunday of October or end later than the hour of 2 a.m. of the last Sunday of March; or
(b) would commence later than the hour of 2 am. of the last Sunday of October or end earlier than the hour of 2 a.m. of the first Sunday of March.
(2)  In this section, the expression the hour of 2 a.m. means that hour as determined by standard time.

3A.   Extension of time for period in 2006

(1)  Notwithstanding section 3 and anything in the Standard Time Act 1895 , from the hour of 2 a.m. of the first Sunday in the month of October 2005 until the hour of 2 a.m. of the first Sunday in the month of April 2006, Tasmanian summer time throughout the State is to be one hour in advance of standard time and is to be observed accordingly.
(2)  An order in force under section 3(1A) is of no effect during the period specified in subsection (1) .
(3)  In this section –
the hour of 2 a.m. means that hour as determined by standard time.

4.   Construction of expressions of time in Acts, &c.

Notwithstanding anything in any enactment, regulation, by-law, rule, proclamation, order-in-council, order, or notice, or in any contract or agreement (whether made orally or in writing), or in any deed or other instrument, where any time or period of time is prescribed, specified, or stipulated as the time at which, or the period of time for which or during which, or any part of which, the doing of any act, matter, or thing is required, permitted, or forbidden, that time, period of time, or part of a period of time, as the case may be, shall, with respect to any period during which Tasmanian summer time is declared by this Act to be in advance of standard time, be held to be, and shall be determined by reference to, Tasmanian summer time unless the contrary is expressed, provided, or stipulated in that enactment, regulation, by-law, rule, proclamation, order-in-council, order, notice, contract, agreement, deed, or instrument.

5.   Savings

(1)  Except as otherwise expressly provided in this Act, the provisions of the Standard Time Act 1895 are not affected by this Act.
(2)  Nothing in this Act affects the use of standard time for the purposes of astronomy, meteorology, or navigation, or the construction of any document mentioning or referring to a point of time in connection with any of those purposes.
