State Fire Commission Superannuation Scheme Act 1994

An Act to provide for the administration of a Superannuation Scheme for members of fire brigades

[Royal Assent 25 November 1994]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the State Fire Commission Superannuation Scheme Act 1994 .

2.   Commencement

This Act commences on a day to be proclaimed.

3.   Interpretation

In this Act –
Board means the Board of Trustees established under section 4 ;
Commonwealth Acts means –
(a) the Superannuation Industry (Supervision) Act 1993 of the Commonwealth; and
(b) the Superannuation Entities (Taxation) Act 1987 of the Commonwealth; and
(c) any other Act enacted by the Commonwealth which relates to the Superannuation Scheme;
Superannuation Scheme means the State Fire Commission Superannuation Scheme;
trust deed means the trust deed referred to in section 6 .

4.   Board of Trustees

(1)  The Minister is to establish a Board of Trustees in accordance with the trust deed.
(2)  The Board is a body corporate with perpetual succession and a common seal.

5.   Meetings of the Board

The Board is to hold meetings as and when the Board determines, but at least once a year.

6.   Trust deed

The State Fire Commission –
(a) must execute a trust deed in respect of the administration of the Superannuation Scheme in accordance with the Commonwealth Acts; and
(b) may amend the trust deed as the Commission and the Board may agree.

7.   Administration of scheme

(1)  The Board is to administer the Superannuation Scheme in accordance with –
(a) the trust deed; and
(b) the Commonwealth Acts.
(2)  An amendment of the trust deed or of the rules of the Superannuation Scheme has no effect unless it is approved by the Minister responsible for the administration of the Public Sector Superannuation Reform Act 1999 .

8.   Transitional provision

On the day of commencement of this Act, any funds administered by, or assets or liabilities vested in, the State Fire Commission as trustees of the Superannuation Scheme immediately before that day are administered by, or vested in, the Board.

9.   

The amendment effected by this section has been incorporated into the authorised version of the Fire Service Act 1979 .

10.   Administration of Act

Until provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990
(a) the administration of this Act is assigned to the Minister for Police and Emergency Services; and
(b) the Department responsible to the Minister for Police and Emergency Services in relation to the administration of this Act is the Tasmania Fire Service.
