Gaming Control Regulations 1994

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following regulations under the Gaming Control Act 1993 .

1.   Short title

These regulations may be cited as the Gaming Control Regulations 1994 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

[Regulation 3 Substituted by S.R. 1995, No. 130, Applied:22 Nov 1995] In these regulations –
Act means the Gaming Control Act 1993 ;
[Regulation 3 Amended by S.R. 1999, No. 11, Applied:09 Mar 1999] fee unit has the same meaning as in the Fee Units Act 1997 ;
nominated associate means any associate of the applicant named in an application for a licensed premises gaming licence under section 36 of the Act.

4.   Fees

[Regulation 4 Substituted by S.R. 1996, No. 121, Applied:04 Sep 1996] [Regulation 4 Subregulation (1) amended by S.R. 1997, No. 139, Applied:22 Oct 1997] [Regulation 4 Substituted by S.R. 1999, No. 11, Applied:09 Mar 1999] The fees specified in Schedule 1 are the maximum fees prescribed for the purposes of the Act.

5.   Duties of special employees

(1)  For the purposes of section 32 of the Act, a special employee's licence authorizes a special employee employed in casino management to carry out one or more of the following duties:
(a) administer, supervise and develop policy and management issues;
(b) supervise and control –
(i) a game of keno; or
(ii) a group of gaming tables; or
(iii) a cash desk; or
(iv) a special tours department; or
(v) a maintenance department; or
(vi) gaming during a day or night shift.
(2)  For the purposes of section 32 of the Act, a special employee's licence authorizes a special employee employed in casino operations to carry out one or more of the following duties:
(a) inspect the operation of a game;
(b) make minor adjustments to a gaming machine;
(c) account for, issue, accept or receive gaming tokens, chips or money;
(d) deal a game or issue keno tickets.
(3)  For the purposes of section 32 of the Act, a special employee's licence authorizes a special employee employed in casino security to protect any person, property or gaming equipment in the casino.

6.   Duties of technicians

[Regulation 6 Substituted by S.R. 1996, No. 121, Applied:04 Sep 1996] For the purposes of section 33 of the Act, the holder of a technician's licence may –
(a) install, maintain and repair gaming equipment determined by the Commission to be integral to a gaming operation, if the holder is authorised to do so by the Commission; or
(b) install, maintain and repair any other gaming equipment, if the holder is not so authorised.

6A.   Offences

[Regulation 6A Inserted by S.R. 1995, No. 130, Applied:22 Nov 1995] For the purposes of section 100(2) of the Act, the following provisions are prescribed:
(a) section 87 ;
(b) section 88 ;
(c) section 89 ;
(d) section 94 ;
(e) section 110 ;
(f) section 111 ;
(g) section 112 ;
(h) section 115 ;
(i) section 116 ;
(j) section 118 ;
(k) section 135 .

7.   Appeals

An appeal to the Supreme Court under section 173 of the Act is to be –
(a) made in accordance with the Rules of the Supreme Court 1965; and
(b) lodged within 60 days of the date on which notice of the decision of the Commission was given.
