Electricity Supply Industry Amendment Act 1998
An Act to amend the Electricity Supply Industry Act 1995
[Royal Assent 19 June 1998]
Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
This Act may be cited as the Electricity Supply Industry Amendment Act 1998 .
(1) Section 5 commences on a day to be proclaimed.(2) The remaining provisions of this Act commence on the day on which this Act receives the Royal Assent.
In this Act, the Electricity Supply Industry Act 1995 is referred to as the Principal Act.
The amendments effected by this section have been incorporated into the authorised version of the Electricity Supply Industry Act 1995 .
5. Section 5 amended (The Regulator)
Section 5 of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:(2) The Commissioner, within the meaning of the Government Prices Oversight Act 1995 , is the Regulator.

8. Section 8 substituted
Section 8 of the Principal Act is repealed and the following section is substituted:8. Administrative fairness and independence
(1) In exercising powers and functions under this Act, the Regulator must not unfairly discriminate between electricity entities, customers for electricity or other persons.(2) In exercising powers and functions under this Act, the Regulator is not subject to the direction of the Minister or any other person.
